I had two accounts with Chase that I set up a debt settlement. The settlement was for me to pay three varying payments for each account. Chase has record of three payments for the 1st account, however, only has record for two payments on the second account. After many many calls to many different departments they could not find record of the third payment for the second account and sent my case to a lawyer who took me to arbitration and I lost. I sent their lawyer a copy of my bank statement showing that I paid the 3rd payment for account #2 prior to arbitration.
However, I still lost arbitration. Now I got a summons for court next month. I’m so frustrated. Do I really need to hire a lawyer now? I’ve sent confirmation from my bank that I made the third payment. Chase says they never got the third and final payment and now I’m being sued. I don’t know what else I can furnish as proof except for my bank statement and the letters I sent to Chase with a copy of the bank statement. I made these payments over the phone. I guess this was a big mistake. What do I do now?
Show up for the hearing next month! Take all of your information showing that you did make the payment. Also, take the information proving that you contacted all these people and tried to show proof of payment. As long as you have all that with you at the court hearing, I’m sure the judge will come down on your side.
Are you continuing to make payments as you’re supposed to on these accounts? If not, you may want to do that so you can show that you are serious about paying and keeping your end of the deal.
No, I have not made any other payments except for the three payments as agreed on the payment dates as agreed (I do have letter from Chase with the debt settlement agreement). I didn’t make any other payments because I paid as agreed, however, Chase says they don’t have record of the 3rd and final payment. I did send them a copy of my bank statement that I paid the third and final payment on the date listed in the settlement papers. I made all three payments over the phone via my checking account. The odd thing is that they took out more on the 3rd payment than what was agreed. I didn’t argue with them because I wanted the thing over and done with, however, I continued to receive statements and I called to find out what was going on and that’s when the told me they didn’t have record of the last payment we agreed to. I really have not idea what where they credited my money, however, I did ask if it was possible that it went to a stranger’s account. No one knew. I don’t know what else I can bring to the summary hearing, however, I paid, I have proof of payment but I’m still afraid of a judgment. I’m afraid I will be arguing against an expert (Chase’s lawyers).

He extended the case and suggested that I speak with the Chase lawyers to “come to an agreement”. He was honoring judgements for every other case presented that morning so I was really nervous that he wasn’t going to listen to what I had to say. The Chase lawyer said she worked for Chase and suggested I contact her office to see if anything could be done but that they were seeking a judgement against me. I never called them but I did call an attorney and went back to court and the case was dismissed. The attorney cost me $500 and I now need to decide if I want to sue for attorney fees.
